The purpose of the Website is to allow participating lenders to share information about individuals and entities party to a loan, so that other lenders can use this information in determining whether to engage with those individuals and entities (the “Service”).

COLLECTION AND USE OF PERSONAL INFORMATION

INFORMATION WE COLLECT ABOUT INDIVIDUALS & ENTITIES

We collect personal information about borrowers & dealers from lenders who choose to input this information into the Service. The personal information that we collect includes:

  • Dba
  • Legal type (partnership, corp, etc.)
  • Tax number
  • Naics code
  • Established date
  • Addresses
  • Links (website)
  • Email
  • Phone
• Identifiers for individuals:
  • Role (applicant, director, etc.)
  • Full legal name
  • Date of birth
  • Addresses
  • Email
  • Phone
  • Social insurance number
  • Passport
• Information about the lender’s experience with the individual or entity
  • Whether the loan was funded or not
  • What date the application was received
  • Whether there was any history of fraud associated with the account

Lenders API relies on its users to obtain consent from the entities and individuals that they are reporting on in order to allow personal information to be shared into the Service and accessed and used by other lenders for the purposes of making lending decisions. By providing us with personal information, the member represents and warrants that they have obtained all necessary consents to provide the member personal information to us for the purposes of providing the Service.

Information we collect about our lenders

We also collect information about our lenders in order to provide them with access to the Service. In order to access the Service a member will need to create an account by providing their name, title, company name, business contact information. We use this information to provide, manage and administer the Service and for security purposes.

We may also collect certain information about lenders automatically when they visit the Website, including IP address, the date and time of the visit, the pages visited, the features used, and the actions taken. This information is used to provide the Website and Service.

We also use cookies and similar technologies to help our Website function, remember preferences and settings and for security purposes. It may be possible to control cookies using browser settings. For example, lenders may be able to set their browser to block or delete cookies, or to notify the member before a cookie is set. If cookies are blocked not all features of the Website may be functional.

Lenders. Certain personal information is shared with participating lenders to assist them in making lending decisions.

Service Providers. We may use service providers to provide certain services on our behalf such as website hosting, data hosting and processing, analytics, marketing and advertising, communications and other services. Some of these service providers may be located outside of Canada, including in the United States.

Business transactions. If Lenders API or any of its assets are sold or merged with another entity, we may share your personal information as part of that transaction.

We and our service providers may disclose personal information in response to a search warrant or other legally valid inquiry or order (which may include lawful access by Canadian, US or other foreign governmental authorities, courts or law enforcement agencies) or as otherwise required or permitted by law.
